By using any of the happiness ai applications, products, services, sites, features and/or functionalities associated therewith (collectively, the “happiness ai”), you consent and agree to the happiness ai terms of use, and the data practices described in the happiness ai privacy policy. If you disagree with any part of the happiness ai terms of use and/or privacy policy, then you do not have permission to access the happiness ai.
communications
Accessing the happiness ai and/or sending emails to the happiness ai constitutes electronic communications. By creating a happiness ai account, you consent to receive electronic communications from us including newsletters, marketing or promotional materials and other information we may send. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send or by sending a written request to delete your happiness ai account.
your account
If you use the happiness ai, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your devices, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that the happiness ai is not responsible for third party access to your account that results from theft or misappropriation of your account. Happiness ai and its trusted service providers reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion. You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene. You must be age 13 (or equivalent minimum age in your home country) to create an account and use the happiness ai. Happiness ai accounts for people under this age should be created by a parent or legal guardian by sending a written request via our help center.
subscriptions
Some parts of the happiness ai are billed on a subscription basis ("paid subscription(s)"). You will be billed in advance on a recurring and periodic basis ("billing cycle"). Billing cycles are set on a monthly or yearly basis.
Subscriptions will automatically renew under the exact same conditions unless you cancel auto-renew or we cancel it. You can change your happiness ai iOS Application auto-renew subscription options in your iTunes account settings or by contacting Apple Inc customer support team. To change other happiness ai auto-renew subscription options please submit a written request via our help center.
fee changes/refund policy
All transactions are final. Subscription fees for the subscriptions may change at any time at sole discretion of happiness ai. Any subscription fee change will become effective at the end of the current billing cycle. We will provide you with reasonable prior notice of any change in subscription fees and give you an opportunity to terminate your subscription before such change becomes effective. Your continued use of the happiness ai, after the subscription fee change comes into effect, constitutes your consent to pay the modified subscription fee amount. Except when required by law, paid subscription fees are non-refundable.
content and intellectual property
You are granted a non-exclusive, non-transferable, revocable license to access and use the happiness ai strictly in accordance with these terms of use. As a condition of your use of the happiness ai, you agree and warrant not to use the happiness ai for any purpose that is unlawful or prohibited by these terms. You may not use the happiness ai in any manner which could damage, disable, overburden, or impair the happiness ai or interfere with any other party’s use and enjoyment of the happiness ai. All content included as part of the happiness ai, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the happiness ai, is the property of happiness ai or its trusted service providers and protected by copyright and other laws that protect intellectual property and proprietary rights. The happiness ai is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of happiness ai.
Happiness ai may contain bulletin board services, chat areas, news groups, forums, communities, personal online pages, calendars, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group. Happiness AI allows you to use, to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content").
By way of example, and not as a limitation, you agree that when posting content on or through the happiness ai, you will not: defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights (such as rights of privacy and publicity) of others, publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information; upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents; upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer; advertise or offer sell or buy goods or services for any business purpose, unless happiness ai specifically allows such messages; conduct or forward surveys, contests, pyramid schemes or chain letters; download any file posted by another user of the happiness ai that you know, or reasonably should know, cannot be legally distributed in such manner; falsify or delete any author attributions, legal or other material contained in a file that is uploaded; restrict or inhibit any other user from using and enjoying the happiness ai; violate any code of conduct or other guidelines which may be applicable for the happiness ai content; harvest or otherwise collect information about others, including e-mail addresses, without their consent; violate any applicable laws or regulations.
Happiness ai has no obligation to monitor the content you post. However, happiness ai reserves the right to review materials posted on or via the happiness ai and to remove any materials in its sole discretion. Happiness ai reserves the right to terminate your access to any or all the happiness ai content at any time and without notice for any reason whatsoever. You retain all your rights to any content you submit, post or display on or through the happiness ai and you are responsible for protecting those rights. We take no responsibility and assume no liability for content you or any third-party posts on or through the happiness ai. Happiness ai reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in happiness ai’s sole discretion.
You may not distribute, modify, transmit, reuse, download, repost, copy, or use said content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.

Happiness ai may contain links to other third-party websites or services. Happiness ai has no control and is not responsible or liable for any content, privacy policies, or practices of any third-party websites or services. Happiness ai is providing these links to you as a convenience, and the inclusion of any link does not imply endorsement by happiness ai of the third party’s content or any association with its activities. We strongly advise you to read the terms, conditions and privacy policies of any third-party web sites or services that you visit.
termination
We may terminate or suspend your account and bar access to the happiness ai immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these terms of use.
If you wish to terminate your account, you may simply discontinue using the happiness ai and/or send us a written request via our help center to delete your happiness ai account.
indemnification
You agree to indemnify, defend and hold harmless happiness ai, its offices, management, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney’s fees) relating to or arising out of your use of or inability to use the happiness ai, any user postings made by you, your violation of any terms, or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Happiness ai reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with happiness ai in asserting any available defenses.
class action waiver
Any arbitration under these terms of use will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. The parties agree that a party may bring claims against the other only in each’s individual capacity, and not as a plaintiff or class member in any putative class, collective and/or representative proceeding, such as in the form of a private attorney general action against the other. Further, unless both you and happiness ai agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.

The information, content, software, products, and services included in or available through the happiness ai may include inaccuracies or typographical errors. Changes are periodically added to the information and content herein. Happiness ai and/or its trusted service providers may make improvements and/or changes to happiness ai at any time.
Happiness ai and/or its trusted service providers make no representations about the suitability, reliability, availability, timeliness, and accuracy of the information, content, software, products, services and related graphics contained on the happiness ai for any purpose. If you are dissatisfied with any portion of happiness ai, or with any of these terms of use, your sole and exclusive remedy is to discontinue using happiness ai.
governing law
These terms shall be governed and construed in accordance with the applicable laws, without regard to its conflict of law provisions. Happiness ai failure to enforce any right or provision of these terms of use will not be considered a waiver of those rights. If any provision of these terms is held to be invalid or unenforceable by a court, the remaining provisions of these terms will remain in effect. These terms of use constitute the entire agreement between us regarding our happiness ai and supersede and replace any prior agreements we might have had between us regarding the happiness ai.
